I. GENERAL PROVISIONS

1. 2. This Procedure establishes the requirements for the federal executive bodies authorized to exercise federal state construction supervision, other federal executive bodies entrusted with state construction supervision by decrees of the President of the Russian Federation, the State Atomic Energy Corporation "Rosatom" and executive bodies the authorities of the constituent entities of the Russian Federation authorized to carry out regional state construction supervision (hereinafter referred to as the state construction supervision body) of checking the compliance of the work performed during the construction and reconstruction of capital construction facilities with the requirements of technical regulations, other regulatory legal acts and project documentation, including the requirements of energy efficiency and requirements for equipping buildings, structures, structures with metering devices for energy resources used (hereinafter referred to as verification rki), and registration of the results of such inspections, as well as the requirements for issuing conclusions on the compliance of the constructed, reconstructed capital construction object with the requirements of technical regulations, other regulatory legal acts and project documentation, including the requirements for energy efficiency and the requirements for equipping the capital construction object with instruments taking into account the energy resources used or making a decision to refuse to issue such an opinion.

2.1. State construction supervision is carried out in cases specified in part 1 of article 54 of the Town Planning Code of the Russian Federation.

2.2. 3. Grounds for conducting inspections:

a) receipt from the developer, technical customer of a notice about the start of construction, reconstruction of a capital construction object, sent in accordance with Part 5 of Article 52 of the Town Planning Code of the Russian Federation, about the completion of construction, reconstruction of a capital construction object;

b) an inspection program developed by the state construction supervision body;

c) receipt from the builder, technical customer, person carrying out construction, notification of changes in the deadlines for completion of work subject to inspection, if the deadline for completion of such work does not coincide with the deadlines specified in the inspection program;

d) receipt from the developer, technical customer, person carrying out construction, notification of cases of emergency situations at the capital construction facility;

e) receipt from the developer, the technical customer, the person carrying out the construction, notification of the elimination of violations, as well as the expiration of the deadline for the legal entity, individual entrepreneur to comply with the order issued by the state construction supervision body to eliminate the identified violation of mandatory requirements;

f) the presence of an order (instruction) of the head (deputy head) of the state construction supervision body, issued in accordance with the order of the President of the Russian Federation or the Government of the Russian Federation or on the basis of the prosecutor's request to conduct an unscheduled inspection as part of supervision over the implementation of laws based on materials received by the prosecutor's office and appeals;

g) appeals and statements of citizens, including individual entrepreneurs, legal entities, information from public authorities (officials of the state supervision body), local governments, from the media about the facts of the accident, violations of technical regulations, other regulatory legal acts and project documentation when performing work in the process of construction, reconstruction of a capital construction facility, including violations of the mandatory requirements for the building materials used, if such violations pose a threat of harm to life and health of people, environment, security of the state, property of individuals and legal entities, state or municipal property or caused such harm;

h) appeals and applications of citizens, including individual entrepreneurs, legal entities, information from public authorities (officials of the state supervision body), local governments, from the media about the facts of attracting funds from citizens for shared construction apartment buildings and (or) other real estate objects in violation of the legislation of the Russian Federation on participation in shared construction of apartment buildings and (or) other real estate objects.

II. PREPARATION FOR CONDUCTING INSPECTIONS DURING STATE CONSTRUCTION SUPERVISION

4. The official (officials) responsible (responsible) for the implementation of state construction supervision at a specific capital construction facility is appointed (appointed) by order (instruction) of the head (deputy head) of the state construction supervision body (hereinafter - the official of the state construction supervision body ) (Appendix No. to this Procedure).

State construction supervision is carried out in the form of inspections.

Inspections are carried out by an official of the state construction supervision body authorized on the basis of the relevant order (instruction) of the head (deputy head) of the state construction supervision body, issued in accordance with the requirements of Federal Law No. 294-FZ of December 26, 2008.

d) estimated time spent by an official of the state construction supervision body for each inspection;

e) documents to be submitted during the inspections provided for by the inspection program;

f) officials or employees of the developer, technical customer or the person carrying out the construction, whose presence during the inspections provided for by the inspection program is mandatory.

In exceptional cases related to the need to conduct and investigate, on the basis of reasoned proposals from the official of the state construction supervision body conducting the inspection, the inspection period may be extended in the manner and for the period specified in Part 3 of Article 13 of the Federal Law of December 26, 2008 No. 294-FZ.

15. The act drawn up on the basis of the results of the audit and the order issued on its basis are drawn up in 2 copies. The materials and documents or their copies drawn up or received in the course of the inspection shall be attached to the inspection report. The first copies of the act and the order, as well as copies of these documents, are sent (handed over) to the developer, technical customer (if there is a technical customer), a person carrying out construction on the basis of an agreement with the developer or technical customer. The second copies of the act of inspection and instructions, as well as documents drawn up or received in the course of the inspection, remain in the file of the state building supervision body.

In the absence of the head, other official or authorized representative of the legal entity, individual entrepreneur, his authorized representative, as well as in the event of the person being checked refuses to give a receipt for familiarization or refusal to familiarize himself with the inspection report, the act is sent by registered by mail with a notification of delivery, which is attached to a copy of the inspection report stored in the file of the state construction supervision body.

16. After the elimination of the violations identified by the state construction supervision body, the developer, the technical customer (if there is a technical customer), the person carrying out the construction, who have committed violations and who have been issued instructions, send notices to the state construction supervision body about the elimination of violations during construction, reconstruction of the capital construction object (Appendix No. to this Procedure).

After the expiration of the period for eliminating the identified violations specified in the order, the state building supervision body, in the prescribed manner, conducts an unscheduled inspection to monitor the implementation of the previously issued order.

In accordance with part 6 of Article 52 of the Town Planning Code of the Russian Federation, the person carrying out construction (the developer or technical customer or the person carrying out construction on the basis of a contract) is obliged to ensure the elimination of identified violations and not to proceed with the continuation of work until the identified deficiencies are eliminated.

I. GENERAL PROVISIONS

2.1. State construction supervision is carried out in cases specified in part 1 of article 54 of the Town Planning Code of the Russian Federation.

3. Grounds for conducting inspections:

b) an inspection program developed by the state construction supervision body;

d) receipt from the developer, technical customer, person carrying out construction, notification of cases of emergency situations at the capital construction facility;

g) appeals and statements of citizens, including individual entrepreneurs, legal entities, information from public authorities (officials of the state supervision body), local governments, from the media about the facts of the accident, violations of technical regulations, other regulatory legal acts and project documentation when performing work in the process of construction, reconstruction of a capital construction facility, including violations of mandatory requirements for the building materials used, if such violations pose a threat of harm to life, human health, the environment, state security, property of individuals and legal entities, state or municipal property or caused such damage;

h) appeals and applications of citizens, including individual entrepreneurs, legal entities, information from public authorities (officials of the state supervision body), local governments, from the media about the facts of attracting funds from citizens for the shared construction of apartment buildings and ( or) other real estate objects in violation of the legislation of the Russian Federation on participation in shared construction of apartment buildings and (or) other real estate objects.

II. PREPARATION FOR CONDUCTING INSPECTIONS DURING STATE CONSTRUCTION SUPERVISION

State construction supervision is carried out in the form of inspections.

d) estimated time spent by an official of the state construction supervision body for each inspection;

e) documents to be submitted during the inspections provided for by the inspection program;

f) officials or employees of the developer, technical customer or the person carrying out the construction, whose presence during the inspections provided for by the inspection program is mandatory.

In the absence of the head, other official or authorized representative of the legal entity, individual entrepreneur, his authorized representative, as well as in case of refusal of the person being checked to give a receipt for familiarization or refusal to familiarize with the inspection report, the act is sent by registered mail with a return receipt, which is attached to a copy of the inspection report kept in the file of the state building supervision body.
